WAIVER AND RELEASE OF LIABILITY 

This Waiver and Release of Liability is entered into between a player/participant and Soccer IQ Elite, LLC (a/k/a Soccer IQ Academy, SIQ Academy, SIQ Elite and SIQ) hereafter known as “SIQ” for participation in any and all SIQ events and activities.  

I hereby assume all of the risks participating in SIQ events and activities, including by way of example and not limitation, any risks that might arise from negligence or carelessness on the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them, or because of their possible liability without fault.

I certify that I am physically fit and have not been advised to not participate by a medical professional.  I certify that there are no health related reasons or problems which preclude my participation in SIQ events and activities.  

I acknowledge that this Waiver and Release of Liability Form will be used by the organizers of SIQ in which I may participate and that it will govern my actions and responsibilities at SIQ.  

1. I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may thereafter occur to me including my traveling to and from SIQ events. THE FOLLOWING ENTITIES OR PERSONS: Soccer IQ Elite, LLC (a/k/a Soccer IQ Academy, SIQ Academy, SIQ Elite and SIQ)
2. I INDEMNIFY, HOLD HARMLESS AND PROMISE NOT TO SUE the entities and persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in SIQ events, whether caused by negligence or otherwise. 

I agree and acknowledge that participation in SIQ events and activities may carry with it the potential for death, serious injury, and personal loss.  The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and lack of hydration. 

Player/participant will not engage in any activity in such a way as to do harm to SIQ, knowing that players may be dismissed from participation by the coaching staff, with possible loss of payment or dues, for violent conduct, unsportsmanlike, disrespectful or unethical behavior on or off the field of play to coaches or other players based on SIQ decision. I agree to pay for any and all damages to any property or others that are caused by me willfully, negligently, or otherwise.

Specific risks vary from one activity to another and the risks range from minor to major catastrophic injuries. Player/participant is in proper physical condition to participate in SIQ events and activities and games and has no illness, disease or existing injury, or physical defect that would be aggravated by participation. Player/participant or parent/guardian will inform SIQ if this status changes. Risks include, but are not limited to, multiple body sprains, broken bones, cuts, bruises, or loss of personal items. In consideration of participation in the activities offered by SIQ, player/participant understands and voluntarily accepts this risk and agrees that SIQ directors, members, owners, and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury from any accidents or any negligence whether related to SIQ activity or in the event that parent/guardian will not be accompanying his/her player/participant in the activity.

I agree to indemnify, defend and hold SIQ harmless against any liability, damages, defense costs, including attorney fees, or from any other costs incurred in connection with claims for bodily injury, wrongful death caused by others, visitors, instructor’s negligence or other wrongful acts or omissions. Further, I understand and acknowledge that SIQ does not manufacture fitness or other sporting equipment, but purchases or leases equipment. I understand and acknowledge that SIQ is providing recreational services and may not be held liable for any defective products. Further, I recognize that minor player/participants cannot receive any medical advice related to any medical condition. In the event of an emergency or non-emergency situation in which my child requires medical attention during the training session, I hereby grant permission to the associated directors, members, owners, independent contractors, administrators, officers, managers, employees, coaches, trainers, volunteers, sponsors and advertisers, and other agents, estates or executors, for any and all medical and/or dental attention to be administrated to my child, at my expense in the event of an accidental injury or illness, until such time as I can be contacted. This permission includes, but does not limit to, the administration of first aid, the use of an ambulance, and the administration of anesthesia and/or surgery, under the recommendation of qualified personnel. 

SIQ cannot guarantee that you, your player/participant, or others, will not become exposed to or infected with Coronavirus Disease and variations (COVID-19) as a result of participating in SIQ programs, events, or activities. Participation in a program, event, or activity could increase the risk of contracting COVID-19. NOW, THEREFORE, in consideration of being permitted to participate in programs, events, and/or activities offered by SIQ, I understand, acknowledge, and agree to the following:

I have independently evaluated and reviewed the risks of being exposed to or infected with COVID-19 and have determined to participate in programs, events, and/or activities with full knowledge and acceptance of the risk. Fully understanding these risks, I, for myself, my child(ren), my spouse, my legal representatives hereby agree to assume full responsibility and liability for the risk of bodily injury, illness, permanent disability, and/or death which may result from exposure to or infection with COVID-19 before, during, or after participating in a program, event, or activity.

I, for myself, my child(ren), my spouse, and my legal representatives waive, release, and discharge SIQ officials, employees, volunteers, attorneys, and agents from any and all liability to me, my child(ren), my spouse, my legal representatives for any and all losses or damages resulting from bodily injury, illness, permanent disability, and/or death, whether caused by the negligence of SIQ owners or its officials, employees, volunteers, attorneys, and agents or otherwise, which claims, losses, and demands arise during or result directly or indirectly from exposure to or infection with COVID-19 before, during, or after participating in a program, event, or activity.

I consent and agree that SIQ and/or their coaches, agents, representatives or volunteers may take photographs or digital recordings of me as a participant during SIQ events and activities and use these in any and all media for training or promotional purposes.  I further consent that my identity may be revealed therein or by description text or commentary.  I waive any rights, claims, or interest and I understand that there will be no financial or other remuneration.  

I authorize my player’s photograph, picture or likeness, and voice to appear in any documentary, promotion, television, video, or radio coverage of the league or tournament, without compensation. I have read this waiver, fully understand its terms, and understand that I have given up substantial rights (including a right to sue SIQ and any of its members, employees, or agents representing or related to SIQ by signing it. I have accepted (signed) it freely and without inducement.

I understand if I cancel a player/participant’s participation for any reason up until forty-eight (48) hours prior to camp, I will receive a credit for SIQ future engagements fees paid that is good through the following year (365 days after notification) for any activity and is transferable only to any immediate family member. I also understand that if my player/participant DOES NOT attend a training session (no-show for any reason) or who does not contact SIQ to cancel at least forty-eight (48) hours prior to activity check-in will not receive a credit or refund.

I understand that the SIQ monthly subscription needs to be canceled fifteen (15) days PRIOR to the next charge of the subscription. If I inform SIQ of cancelation less than fifteen (15) days before the next charge, the charge for the next month will be applied and my player/participant can attend another month of training before the subscription is canceled.

I acknowledge that I have given up substantial rights by accepting this document and that I do so voluntarily. My signature attests to this on behalf of myself and my executors, personal representatives, administrators, heirs, next-of-kin, successors, and assigns. As the parent and natural guardian or legal guardian of the participant, I hereby agree to the foregoing Waiver and Release of Liability for, and on behalf of, the participant (player/minor) named above. I hereby bind myself, the minor, and all other assigns to the terms of the Waiver and Release of Liability. I represent and certify that I have the legal capacity and the authority to act for, and on behalf of, the minor in the execution of this Waiver and Release of Liability.

I authorize that an unaltered copy of this form may be generated and given to legal authorities, officers, or directors of various soccer activities (leagues or tournaments) in order to prove and allow participation in SIQ events and programs if a participation form is required and I have requested to participate.

By signing this Waiver intending to be legally bound, I acknowledge I assume certain risks and waiving certain rights, including a right to sue. I did read it carefully before signing, agreeing to release from liability and to indemnify and hold harmless any of its members, employees, contractors, or agents representing or related to SIQ. I acknowledge that I have given up substantial rights by accepting this document and that I do so voluntarily. My acceptance, through signature, attests to this on behalf of myself and my executors, personal representatives, administrators, heirs, next-of-kin, successors, and assigns

The accident waiver, release of liability, and image release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. 

PARENT/GUARDIAN WAIVER FOR MINORS 

The undersigned parent or natural guardian does hereby represent the she/he is, in fact, acting in such capacity, has consented to his/her child participation in SIQ events and activities, and has agreed individually and on behalf of the minor or ward, to the terms of the accident waiver and release of liability set forth above.  The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all parties referred to above from all liability, loss, cost, claim, or damages whatsoever which may be imposed upon said parties because of any defect on lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
